1. WHO WE ARE
Football365.co.za is a brand owned by TEAMtalk Media, (Registration No. 2005/014031/07), which is an indirect subsidiary of British Sky Broadcasting Group plc (Registration No. 2247735). TEAMtalk Media is incorporated in South Africa at the registered office at 5th Floor, The Warehouse Building, 24 Alfred Street, Foreshore, Cape Town, 8001.
2. CONDITIONS OF USE
2.1 Use of the Services and WAP site
This WAP site, the information, and the goods and services on it are offered to you for your personal and non-commercial use only. Commercial use of this WAP site is strictly prohibited.
You agree to comply with all applicable laws, statutes and regulations in connection with the use of the WAP site and goods (the "Goods") or services (the "Services") obtained via the WAP site. The Goods and Services are together referred to as the "Supplies".
By using the WAP site, you unconditionally agree to be bound by these terms and conditions.
2.2 Restrictions on Use
As a condition of your use of this WAP site and the Services you agree that you will not:
(a) reverse engineer or decompile (whether in whole or in part) any software available through the WAP site (save to the extent expressly permitted by applicable law);
(b) remove, change or obscure any product identification or notices of proprietary rights or any restriction on or in the Supplies and/or the WAP site;
(c) remove any copyright, trade mark or other intellectual property right notices contained in material on the WAP site or Supplies;
(d) make copies, modify, reproduce, republish, post, transmit, distribute or alter (including the creation of links to or from the WAP site) all or any part of the WAP site or any materials contained on it.
2.3 Unlawful or Improper Use
You must not use the WAP site or the Supplies for any unlawful purposes. In particular, you must not:
(a) publish, post, upload, distribute, disseminate or otherwise transmit, information or pictures that are obscene or pornographic, threatening, menacing, racist, offensive, defamatory, libelous, or are alleged to be, or are in the opinion of TEAMtalk Media, otherwise unlawful;
(b) upload files that contain software or other materials in breach of any intellectual property rights or in breach of confidence;
(c) download any file of materials posted by another user that you know, or reasonably should know cannot be copied or otherwise used legally;
(d) harass, stalk, threaten or otherwise infringe the rights of others;
(e) hack into any WAP site, deliver viruses or forward chain letters, surveys, contests, pyramid schemes or engage in any other behaviour likely to inhibit any other user from using and enjoying the WAP site or the Services or that is otherwise likely to damage or destroy the reputation of the WAP site;
(f) advertise or offer to sell goods or services;
(g) use/access this WAP site if you are under 16 years. If so, you require the consent of your guardian. By continuing to use/access this site you warrant that you are 16 years or older or that you have your guardians permission.
2.4 Monitoring and disclosure
TEAMtalk Media accepts no obligation to (but may in its discretion) monitor the use of the WAP site and/or the Services by you. TEAMtalk Media reserves the right to disclose any information or material which may be provided by you if required by law or regulations and to remove, refuse to post or to edit any such information or material and to take such other action as may be reasonably necessary to prevent any breach of these terms and conditions.
3. USERNAMES AND PASSWORDS
Following any registration by you, TEAMtalk Media will deliver your user name and password to you. Delivery may be by any reasonable means (including electronic or postal delivery).
You must keep your user name and password confidential at all times. Any breach of these terms and conditions by anyone to whom you disclose your password will be treated as if the breach had been committed by you, and will not relieve you of your obligations under these terms and conditions.
You must take appropriate security measures to prevent unauthorised disclosure of your user name and password and you must notify TEAMtalk Media immediately if your password becomes known to any unauthorised user.
You must notify TEAMtalk Media of any changes to your registration details.
4. DATA PROTECTION
4.1 Protection of Information
Your personal details shall be processed by TEAMtalk Media, any of its parent or subsidiary companies, any related company, by their staff and employees according to the Protection of Information Bill 2008 and/or applicable legislation that governs the authentication, protection and disclosure of personal information.
You acknowledge and agree that any information kept by us in relation to this agreement, including the nature of your transactions, may be disclosed to Banks, Financial Institutions, the Independent Communications Authority of South Africa, the Wireless Application Service Providers Association, Police and/or the Security Service and other regulatory bodies as may be required by law.
You acknowledge and agree that upon deregistration, your personal data shall be retained and processed by us, our subsidiaries or any authorised third party, for a period of 6 (six) months.
4.2 Service and billing
You acknowledge and agree that we may contact you by mail, telephone, email, electronic messaging including text messaging or fax for the purpose of providing service and billing information and updates, for credit scoring purposes and other customer services.
You acknowledge that it is in your interest to advise us of any changes in your status so that our records are kept up to date.
4.3. Marketing and Promotions
You acknowledge and agree that your personal data shall be used and processed for the purpose of direct marketing and promotion, and that we may send you information about other products and services supplied by us or any of our subsidiary companies, by mail, mobile, telephone, email, electronic messaging including text messaging or fax. You may, by written notice to us, oppose the processing of your personal data for direct marketing purposes.
5. INTELLECTUAL PROPERTY RIGHTS
This WAP site (including the software used to operate it) are owned by the content aggregator MobiMedia and the domiain, trade marks and any information or material used in connection with the WAP site and the Supplies are owned by TEAMtalk Media and/or its licensors. You are not granted any right or interest in these except as stated in these terms and conditions.
